COLONIAL NURSERYS LIMITED WARRANTY

Effective July 1, 2001

• The following items carry NO WARRANTY:  CRAPE MYRTLE, DOGWOOD TREES,

SOUTHERN MAGNOLIAS, PECAN, WALNUT, HAZELNUT, BERRIES, GRAPES,

ANNUALS, PERENNIALS, GROUND COVERS, BULBS, TROPICALS, SEEDS, OR

TREES USED FOR CHRISTMAS TREES.

• The following items will be warranted until NOVEMBER 1 of the same year: ROSES,

AZALEAS, and RHODODENDRONS.

• Nursery stock (other than mentioned above), with a retail value of $ 9.00 or more,

and which has been given reasonable care, will be warranted for ONE YEAR,

From the date of purchase.

• Customers WARRANTY TICKET AND DEAD PLANT, must accompany request for

Credit , whether customer plants or the nursery plants.

• CANCELLED CHECKS OR CREDIT CARD STATEMENTS WILL NOT BE

ACCEPTABLE FOR PROOF OF WARRANTY

• NO CASH REFUND WILL BE GIVEN WITH RESPECT TO WARRANTY CLAIMS.

• If loss occurs to nursery stock, a CREDIT SLIP will be issued FOR THE AMOUNT

 PAID FOR PLANT MATERIAL ONLY.

• LABOR CHARGE FOR PLANTING TREES IS 65%-100% of the price of the tree on

most trees. Staking, mulch and compost is included. Minimum planting fees apply.

• LABOR CHARGE FOR PLANTING OTHER NURSERY STOCK IS 60% of the price

of plant material on most plants. Compost is included. Minimum planting fees apply.

• NO WARRANTY FOR ANY LABOR CHARGES.  A labor charge will be charged each

time we plant.

• Nursery stock will have a ONE TIME REPLACEMENT CREDIT only.

• We do not warranty rate of growth on any plant.

• Nursery stock prices subject to change without notice. We DO NOT REPLACE

NURSERY STOCK, TREE FOR TREE, PLANT FOR PLANT, unless prices are the same.

• Colonial Nursery will not be responsible for lawn care damage, malicious destruction or

Insect damage or any act of god, such as drought, wind, hail, freezing and flood.

• ACCOUNTS MUST BE PAID IN FULL BEFORE ANY CREDIT IS ISSUED OR

REPLACEMENTS ARE MADE. THIS WILL INCLUDE INTEREST CHARGE.

• $50.00 charge will be made for examining nursery stock at the customers request.

• We charge $20.00 for all returned checks.

THIS TICKET MUST BE RETAINED FOR YOUR WARRANTY—

THIS IS THE ONLY COPY.

• INTEREST WILL BE CHARGED AT 1 ½% PER MONTH [18% PER ANNUM]

ON ALL ACCOUNTS NOT PAID BY 30 DAYS FROM THE BILLING DATE.
